Terms of Service

Effective Date: August 4, 2025

1. Services Provided

We provide web design, website setup, hosting, and related digital services as described in your selected package or project agreement. Additional services may be provided by mutual agreement.

2. Client Responsibilities

• Content: You are responsible for providing all website content, images, and materials (unless specified in your package).
• Timely Response: Please respond promptly to requests for feedback, materials, or approvals. Delays may affect project timelines.
• Accuracy: You confirm all materials you provide do not infringe on others' rights and comply with all laws.

3. Payment & Deposit

• A 50% deposit is required before work begins. The remaining balance is due upon completion and before the website is launched or delivered.
• Payment can be made by e-transfer, credit card, Stripe, or other agreed methods.
• Hosting, maintenance, and add-on fees are billed as described in your package (recurring or one-time).
• The final payment is due only when you are satisfied with the final product.

4. Project Timelines & Revisions

• Standard turnaround is typically 1–3 weeks after receiving all required materials and deposit (actual time may vary).
• No strict limit on revisions—if changes become excessive or the scope shifts significantly, we will discuss options and additional fees.
• Delays caused by late materials or responses are not the responsibility of Simply Starters Web Design.

5. Handover & Access

• Upon completion and full payment, you will receive all website logins, admin usernames, and passwords related to your project.
• You have full access and control over your website, hosting, and related accounts.
• We provide free password reset assistance as part of your hosting package.

6. Ownership & Copyright

• Once the final payment is received, you own the website’s content, design, and graphics (excluding stock images or third-party assets, which are licensed to you).
• We reserve the right to display your completed website in our portfolio or for promotional purposes (with your permission).

7. Hosting & Maintenance

• 3 months of free hosting are included with every new website package. After that, hosting is billed at $10/month (cancel anytime).
• Maintenance packages are available for ongoing updates and support (see our plans).
• Failure to pay hosting or maintenance fees may result in website suspension or removal after written notice.

8. Cancellations & Refunds

• If you cancel before work begins, your deposit will be refunded.
• If you cancel after work has started, the deposit is non-refundable, but any additional payments for unfinished work will be refunded.
• We reserve the right to cancel a project for non-payment or breach of these terms, with notice.

9. Liability & Disclaimers

• We strive to deliver high-quality, secure, and reliable websites. However, we are not liable for any indirect, incidental, or consequential damages arising from your website or its use.
• We are not responsible for content provided by the client, downtime due to third-party hosts or services, or events outside our control.
• Client is responsible for complying with all applicable laws (including privacy and accessibility) for their website.

10. Privacy

• Our Privacy Policy explains how we handle your personal information.
• Each client is responsible for their own website’s privacy practices and policies.

11. Changes to These Terms

We may update these Terms of Service from time to time. The latest version will always be available here with the effective date.
